Unless there is a clear and immediate danger, FDA ingredient bans follow a timeline between initial proposal and required compliance date. This allows industry time to reformulate as needed. An ingredient is officially banned once the FDA Publishes a Final Rule in the Federal Register. The Final Rule provides the compliance period for the ban. The compliance period is often 1 to 2 years out from the date of Final Rule publication to allow for reformulation and inventory depletion.
The goal is to make the swap raw material without your customers noticing the change. Suppliers are a great source to recommend alternative ingredients. Flavors with modulation technology can often help to bridge gaps in your reformulation.
